CISA Guidance Clarifies How to Share Cyber Threat Information… but Issues Remain

The Cybersecurity Information Sharing Act of 2015 (« CISA »), enacted on December 18, 2015, as part of the omnibus Consolidated Appropriations Act[1], 2016, creates a voluntary process that encourages public and private sector entities to share cyber information without the threat of litigation while simultaneously protecting privacy. Guidance recently issued by the Department of Homeland Security (« DHS ») clarifies the types of information and the means for sharing to preserve liability protection under CISA. While the DHS guidance is instructive, a number of issues regarding CISA remain.
